Terms and Conditions of Rental

Introduction

These Terms and Conditions of Rental define the booking, payment, cancellation and stay conditions applicable to seasonal rentals of the house on Île de Sieck, located off the coast of Santec, in Northern Finistère, Brittany.

Any booking request or booking made through the website iledesieck.fr implies full acceptance of these Terms and Conditions by the guest.

These conditions may be supplemented by a seasonal rental agreement sent to the guest before or after confirmation of the booking.


1. Identification of the owner

The owner reserves the right to request any information from the guest that may be necessary for the proper organisation of the stay.


2. Property offered for rental

The rental concerns the house on Île de Sieck, a property located on a private island of approximately 17 hectares, off the coast of Santec, in Brittany.

The house has a surface area of approximately 250 m², includes 5 bedrooms and can accommodate up to 10 guests.

The rental concerns the entire house, for a private seasonal stay. It does not constitute a main residence, a long-term rental or a residential lease.


3. Maximum capacity

The maximum capacity of the house is strictly limited to 10 guests.

The number of guests stated at the time of booking must correspond to the actual number of people present during the stay, including children, unless specific written agreement has been given by the owner.

Any unauthorised exceeding of the maximum capacity may result in immediate termination of the stay, without refund or compensation.


4. Booking

Bookings are made online through the website iledesieck.fr, subject to availability for the selected dates.

A booking request does not automatically constitute a confirmed booking. Requests are reviewed before confirmation, in particular to check access conditions, tide times and the practical organisation of arrival.

The guest may be asked to enter payment card details through the secure payment provider. No amount is charged at the time the request is submitted, unless otherwise stated during the booking process.

The booking becomes firm only after approval by the owner or the owner’s representative, validation of the requested payment and confirmation through the booking system or by the owner.

The owner reserves the right to refuse or cancel any booking request that is manifestly erroneous, incomplete, fraudulent or not compliant with these Terms and Conditions.


5. Rates

Rates are indicated in euros, inclusive of all applicable taxes where relevant.

The displayed price may depend in particular on:

  • the dates of the stay;
  • the pricing season;
  • the number of nights;
  • the number of guests;
  • the tourist tax, where applicable;
  • compulsory cleaning fees;
  • any additional services expressly requested and confirmed.

Prices may be amended at any time. However, the applicable price is the one validated at the time of booking confirmation.

Compulsory cleaning fees are added to the booking: €120 for a two-night stay and €180 for stays of more than two nights, unless otherwise stated during the booking process.


6. Payment

Payment is made according to the terms indicated at the time of booking.

Depending on the settings defined by the owner, the booking may require:

  • full payment of the stay;
  • payment of a deposit;
  • entry of a payment card before manual approval of the request;
  • or any other payment method expressly accepted by the owner.

When online payment is available, it is processed by a secure payment provider, including Stripe. The guest’s bank details are not stored directly by the website iledesieck.fr.

Where the booking process provides for manual approval, the payment card may be securely saved via Stripe when the request is submitted. The payment is then charged only after the request has been approved by the owner or the owner’s representative.


7. Tourist tax

Tourist tax, where applicable, is payable by the persons staying at the property and is collected in accordance with the regulations in force.

Its amount depends in particular on the category of accommodation, the number of guests liable for the tax and the number of nights. Minors may be exempt from tourist tax according to the applicable rules.

Tourist tax may be included in the displayed price or added at the time of booking, depending on the website settings and the applicable local regulations.


8. Security deposit

A security deposit of €500 may be requested in order to cover any damage, loss, additional costs or breaches observed during the stay.

The amount of the security deposit is indicated at the time of booking or in the seasonal rental agreement.

Unless otherwise stated, the security deposit is charged together with the stay payment after the booking request has been approved.

The security deposit is refunded within a maximum period of 7 days after departure, subject to inspection of the property, equipment and furnishings, and compliance with these Terms and Conditions.

In the event of damage or costs attributable to the guest, all or part of the security deposit may be retained, after inspection and justification.


9. No right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to accommodation services that are to be provided on a specific date or during a specific period.

Any confirmed booking is therefore subject to the cancellation conditions set out below.


10. Cancellation conditions

Unless specific conditions are stated at the time of booking, the cancellation conditions are as follows:

  • cancellation more than 30 days before arrival: partial refund according to the agreed conditions;
  • cancellation less than 30 days before arrival: deposit retained;
  • cancellation less than 7 days before arrival: the full amount of the stay is due.

Any cancellation request must be made in writing.

In the event of interruption of the stay by the guest, late arrival or early departure, no refund shall be due, unless otherwise agreed in writing by the owner.


11. Access to the island and tide times

Access to Île de Sieck depends on the tides. It is generally possible around low tide, within an indicative window of approximately 2 hours 30 minutes before and 2 hours 30 minutes after low tide, subject to actual conditions observed on site.

The guest acknowledges that this constraint is an essential characteristic of the stay.

Before arrival, the owner or the owner’s representative will provide the guest with the necessary information to organise access to the island in the best possible conditions.

The guest undertakes to respect the times communicated and to organise arrival, departure and movements according to the tides.


12. Arrival and departure

Arrival and departure times are defined according to availability, organisational requirements and tide times.

The guest must arrive at the agreed times. In the event of delay or impossibility of access resulting from failure to follow the instructions provided, the owner cannot be held liable.

The precise terms of arrival, key handover and departure are communicated before the stay.


13. Use of the property

The property is rented exclusively for private seasonal holiday use.

The following are prohibited without the owner’s prior written authorisation:

  • subletting;
  • transfer of the contract;
  • organisation of events;
  • receptions open to third parties;
  • filming, photo shoots or commercial use;
  • any activity not compliant with the intended use of the property.

The guest undertakes to respect the property, furniture, equipment, the natural environment of the island and all instructions communicated before or during the stay.


14. Guest liability

The guest is responsible for their own conduct, for the conduct of the persons accompanying them, and for any damage caused to the property, equipment, environment or third parties.

The guest undertakes to use the equipment made available with care and in accordance with its normal use.

The guest acknowledges that the stay takes place in a natural, maritime and isolated environment. The guest accepts the risks inherent to this environment, particularly when moving around, walking, accessing the foreshore, taking part in outdoor activities or using the equipment.


15. Insurance

The guest must be covered by holiday civil liability insurance for the entire duration of the stay.

The owner may request an insurance certificate before the guest enters the property.

Failing sufficient cover, the guest remains personally liable for any damage caused during the stay.


16. Resources, water and energy

Given the island location and the preserved nature of the place, the guest undertakes to use water, energy and available resources responsibly.

Any manifestly excessive consumption, damage, loss, misuse or deterioration of equipment may be charged to the guest after inspection.

The guest also undertakes to comply with instructions relating to waste, safety, heating, technical equipment and the preservation of the island’s natural environment.


17. Additional services

Additional services may be offered on request and subject to availability, including grocery delivery, seafood platters, catering, a private chef or crêpier, nautical activities, guided visits, fishing-related services or special arrangements.

These services may be subject to additional charges and must be confirmed in writing.

The owner cannot be held liable for the unavailability of an external provider or of any service that has not been confirmed.


18. Force majeure

The owner cannot be held liable for unforeseeable, unavoidable or external events preventing or disrupting the normal performance of the stay.

This includes, in particular: exceptional weather conditions, maritime constraints, access restrictions, natural events, interruption of services beyond the owner’s control, or temporary impossibility of access to the island.


19. Immediate termination

In the event of non-compliance with these Terms and Conditions, exceeding the maximum capacity, dangerous behaviour, serious disturbance, damage, unauthorised use of the property or failure to comply with essential instructions relating to access to the island, the owner may terminate the stay immediately.

In such a case, no refund or compensation shall be due to the guest.


20. Complaints

Any complaint relating to a stay must be sent in writing to the owner as soon as possible, at the following address:

The guest is invited to report any problem during the stay so that the owner or the owner’s representative can intervene as quickly as possible.


21. Consumer mediation

In accordance with the provisions of the French Consumer Code, a consumer guest may refer the matter free of charge to a consumer mediator in the event of a dispute that has not been resolved directly with the owner.


22. Personal data

Personal data collected during the booking process is used to manage the request, confirm the stay, provide customer follow-up, issue invoices and perform the booked services.

The guest has rights over their personal data in accordance with the applicable regulations.

23. Applicable law and jurisdiction

These Terms and Conditions are governed by French law.

In the event of a dispute, and failing an amicable resolution, the competent courts shall be determined in accordance with the applicable rules of procedure.
